Voluntary Termination in Motor Finance: A Lender's Guide


Voluntary Termination (VT) is one of the most frequently misunderstood and poorly managed areas of consumer motor finance in the UK. Under Section 99 of the Consumer Credit Act 1974, customers have a statutory right to terminate a hire purchase or conditional sale agreement once they have paid 50% of the total amount payable. Here is what lenders need to know to manage VTs correctly, compliantly, and commercially.
A valid Voluntary Termination requires: the customer to have paid at least 50% of the total amount payable under the agreement (including all charges); the customer to have taken reasonable care of the vehicle throughout the period of the agreement; and the customer to return the vehicle in a condition consistent with that reasonable care standard. The lender cannot seek payment for depreciation or normal wear and tear. However, damage beyond the BVRLA Fair Wear and Tear Guide standard is recoverable.
Voluntary Termination volumes have increased significantly in recent years as consumer awareness of VT rights has grown -- partly driven by claims management companies who target customers with large outstanding balances. Lenders face several challenges: vehicle condition disputes, where customers and lenders disagree on what constitutes fair wear and tear; logistics complexity, as vehicles may be located anywhere in the UK and need to be collected, inspected, and remarketed; and data management, as the VT process generates significant documentation requirements.
The vehicle condition report produced at the point of VT collection is the single most important document in a VT dispute. An inadequate, poorly photographed, or incomplete report will leave the lender unable to pursue legitimate damage claims.
